In my post on January 8, I claimed that the ICE officer who shot Renee Good in Minneapolis could face manslaughter or even murder charges under Minnesota state law. Under normal circumstances, the Minnesota Bureau of Criminal Apprehension, would investigate the shooting, jointly with the FBI. The two agencies would establish the facts and then turn the case over to the state and US Attorneys General. If warranted, the Minnesota Attorney General would bring charges under state law, and the US Attorney General&#8217;s civil rights division would bring federal charges under civil rights law. That is the way the killing of George Floyd in Minneapolis was investigated and the police officer who was primarily responsible, Derek Chauvin, was tried and convicted of the killing.<\/p>\n<p>No such joint investigation this time around. The FBI refused to cooperate with the Minnesotans and withheld all evidence. The US Justice Department&#8217;s civil rights division did initiate an investigation, but that was immediately shut down by the US Attorney General. Before any investigation could be initiated, the Secretary of Homeland Security, Kristi (Cowgirl) Noem, declared that the shooting was justified as it was in self-defense because Renee Good was trying to run the officer over.<\/p>\n<p>Whether a person acts in self-defense or not is not easy to determine. It depends on whether the shooter was truly in fear of his or her life and whether there were other, non-lethal options available. That is why in cases like this, an investigation is absolutely necessary. Noem&#8217;s claim that the shooting was in self-defense and therefore justified before any investigation is conducted is therefore at least pre-mature. It is furthermore contradicted by the evidence available at the time which seemed to show that Good was trying to drive away. The wheels of her car were turned away from the officer who had placed himself in front of her car. This makes the high-level efforts to prevent any investigation being carried out more than a little suspicious.<\/p>\n<p>We will never know whether the shooting was legally justified or not. Instead of looking into this, the FBI is now investigating the victim&#8217;s background. In her first statement after the shooting, Noem described Renee Good and her partner as &#8220;domestic terrorists.&#8221; \u00a0The US Attorney General and the Secretary of Homeland Security have charged the FBI with finding (or generating?) evidence to back up that claim.<\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][\/et_pb_section]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>I hate to admit it, but I was wrong.
